Pre-existing Injury and Disputed Liability – $125,000
The case of the month for was a $125,000.00 personal injury settlement for a disputed liability rear end collision. The defendant driver contended that our client cut in front of his vehicle and slammed on her brakes. Our client’s vehicle had mild to moderate damage to its rear end and the impact caused her to primarily suffer from lower back pain.
Our client underwent conservative treatment and lumbar steroid injections. Her treatment included, chiropractic care, imaging, pain management care, and some psychological care.
Prior to the incident, our client had several prior claims related to lower back injuries. The third party insurance never provided any formal offers during pre litigation. After months of litigation, including written discovery, deposition, independent medical examination, and vehicle inspection, we were able to schedule mediation. At the end of the mediation, the mediator provided a proposal of $125,000.00 to settle the matter. Our client wanted to resolve the case without proceeding through trial and was completely happy with the result and our representation.
