Rear End & Initial Low Ball Offer – $150,000
Our client was rear-ended while stopped in traffic when the defendant came around a blind corner at high speed and struck his vehicle with significant force. Although his Toyota Prius remained drivable, the impact caused multiple injuries, including pain to his neck, head trauma, and eye, as well as symptoms consistent with whiplash due to the force of impact. He also experienced a contusion and abrasion near his left eye. Our client was evaluated by the fire department at the scene and later sought care at the hospital, where he was taken off work from his job.
Our client was consistent with his medical treatment. He received diagnostic imaging, ongoing conservative care, and follow-up evaluations for his neck and head injuries with specialists. His treatment plan included additional physical therapy and additional specialist consultations as needed. He underwent one lumbar spine injection for his lumbar spine disk herniations. Due to his constant pain, he was recommended a lumbar spine surgery. He ultimately declined obtaining this surgery, despite his doctor’s recommendations.
The client’s medical bills totaled $65,000.00. Although he did not obtain the recommended surgery, we used the future surgical treatment recommendation to advocate for a higher settlement. The insurance company made an initial “low ball” offer of $40,000.00 to settle. Through persistent negotiation, we secured a $150,000.00 settlement for our client. This case highlights the importance of strong advocacy and thorough documentation and advocating for future care — as well as the value of pressing forward even when insurers attempt to downplay injury severity due to lack of obtaining treatment.
