Our client was in his sedan Honda Civic, and stopped at a red light in Rancho Cucamonga, when the at fault driver forcefully rear ended him, causing severe property damage. Our client’s vehicle was a total loss. As a result of the accident, our client sustained injuries to his neck, low back, left wrist, legs, left ankle/foot, and laceration to the back of his head. Moreover, our client also stated that he started experiencing seizures after the accident, however, his medical reports were not favorable to prove that the seizures were a direct result from the accident.

His treatment was somewhat consistent, but he was a no show on multiple injection appointments that had been rescheduled multiple times. He was extremely afraid of needles and blood and would almost faint every time. After the initial emergency hospital visit, he was seen by the MD, chiropractic care sessions, MRIs, ortho, received bilateral lumbar medial branch blocks at L3–4, L4–5, and L5–S1, Neurologist, pain management, received bilateral lumbar facet PRP injections at L4–5 and L5–S1. Our client’s total meds were $71,942.00.

We made a policy limits demand. First offer was a little over $93k and after about 4 rounds of negotiations and many phone conversations, we finally settled the case at $112,000.00, which that client was very happy with. The insurance did not believe that the case was worth the policy limits due to the seizures not being able to be proven to be from the accident. We had to make a strategic decision to tell the insurance to evaluate the claim without the evidence of the seizures. The rest of the medical records indicated that all the client’s injuries had been resolved, especially his lower back pain.

Ultimately, the client was very pleased with the outcome, especially since we were also able to handle another of his liens.
