Head-on Collision Involving Uninsured Motorist – $225,000
The client was a passenger in her daughter’s vehicle when it was involved in a collision when the vehicle ahead of them went into oncoming traffic, colliding with a car head on. A third vehicle, in an attempt to avoid that collision, swerved into oncoming traffic and struck our client’s vehicle, causing it to roll. The initial at fault driver had no insurance and the carrier for the vehicle our client was in afforded uninsured motorist coverage with combined $60,000 policy limits. Additionally, our client carried her personal auto policy that provided uninsured motorist coverage with a $100,000 policy limit. The insurance carrier for the vehicle that struck our client’s car, initially denied liability placing all fault on the vehicle that caused the collision, which their insured was attempting to avoid.
Our client underwent ER treatment as well as subsequent conservative care, including chiropractic, MRIs and evaluations with pain management MDs and orthopedic MDs. She was experiencing numbness and neuropathy in her lower extremities prior to the collision, but frequency increased after the accident. The total incurred medical bills were $74,710.51, $18,519.02 after health insurance payments.
We were able successfully obtain maximum policy limits of $25,000 (apportioned) and $100,000 from the uninsured motorist policies. We were also able to pursue the insurance carrier and ultimately they also paid their total available policy of $100,000. Total settlements combined were $225,000
